1. Acceptance of Terms

By downloading, installing, or using the WaveLift app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the Service or create an account.

3. Use of the Service

WaveLift grants you a personal, non-exclusive, non-transferable license to use the app for your personal, non-commercial fitness tracking purposes. You agree not to:

• Reverse engineer, decompile, or disassemble the app
• Use the app for any unlawful purpose
• Upload content that is offensive, abusive, or violates any third-party rights
• Attempt to gain unauthorized access to any part of the Service or its infrastructure

3. Subscription Terms

WaveLift Pro offers premium features through auto-renewing subscriptions managed by Apple:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription at any time through your Apple ID account settings or the App Store.
• No refunds are provided for partial subscription periods, except as required by applicable law.
• Prices are subject to change with reasonable notice.

4. User Content

You retain ownership of any workout videos and data you upload to the Service. By uploading content, you grant WaveLift a limited license to store and display that content solely for the purpose of providing the Service to you. You are solely responsible for ensuring that your uploaded content does not violate any applicable laws or third-party rights. We reserve the right to remove content that violates these Terms.

5. Medical Disclaimer

WaveLift is a fitness tracking tool and is not a medical device or service. The information provided by WaveLift is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before beginning any new exercise program, especially if you have a pre-existing medical condition or injury. You assume all risk associated with your use of the app and any exercise activities.

6. Limitation of Liability

To the fullest extent permitted by applicable law, WaveLift and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time. If you delete your account, your data will be removed in accordance with our Privacy Policy.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
